Game Locker Pty Ltd (ABN 16 684 573 822) (Game Locker, we, us) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and protect your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

This Policy applies to our website (gamelocker.co), the Game Locker app, the Game Locker Marketplace, our store platform, and related services (together, the "Services"). It replaces our previous Website Privacy Policy.

Minors: The Services are intended for use by persons aged 18 and over. Children should only access the Services through a parent or guardian's registered account, with supervision by the relevant parent or guardian. We do not knowingly collect information from children and if we become aware that a child has provided us with personal information without appropriate parental or guardian consent, we will take reasonable steps to delete that information.

1. What Information We Collect

Account information: your name, email address, phone number, username, and date of birth when you create an account.

Guest checkout: your name, email address, phone number, date of birth and shipping address.

Marketplace activity: orders, purchases, sales, listings, delivery addresses, click-and-collect selections, reviews and ratings, and communications with us or with other users through the Services.

Identity verification (store sellers and individual sellers): before you can sell on the Marketplace, we collect information to verify your identity, which may include your legal name, date of birth, residential address, details or images of government-issued identification, and the results of verification checks performed by our third-party verification provider. At the date of this Policy, we use Stripe as our verification provider, but we reserve the right to use different providers from time to time. Our third-party provider collects and handles your personal information in accordance with their own privacy policies and we only receive the result (pass or fail) of the verification check they perform.

We also collect your bank account details to remit your sales proceeds.

My Locker and card scanning: the contents of your card collection, including card details, condition, quantity, and any purchase prices you choose to record, and images captured through your device's camera when you use card scanning features. Camera access is only used with your permission.

Payment information: payments are processed by our third-party payment processor (who at the date of this Policy, is Stripe, but we reserve the right to use different providers from time to time). We do not store your full card number.

Technical and usage information: IP address, browser type, device data, referring website, app usage, and browsing behaviour.

Website enquiries and marketing: information you provide through contact forms or newsletter sign-up.

Employment and contracting: if you apply for employment or a contracting engagement with us, your application materials and employment history. (However, this Policy does not cover employee records.)

2. How We Collect Your Information

We collect information directly from you (when you create an account, list or buy products, complete identity verification, scan cards, or contact us), automatically through your use of the Services (including cookies and similar technologies), and from third parties including our identity verification provider, payment processor, fraud prevention services, and users you transact with. You can browse the Services without providing the personal information required to create an account, but will be required to register before buying or selling any items.

3. How We Use Your Information

We use your personal information to:

  • Provide and operate the Services, including processing orders, payments, refunds, and seller remittances;
  • Verify your identity before enabling selling privileges, and prevent fraud, money laundering, and misuse of the Marketplace;
  • Monitor activity in the Marketplace to operate and maintain the Marketplace, and protect the Marketplace and its users, and to verify compliance with and enforce the Game Locker Marketplace Terms;
  • Improve our Services, website and other offerings;
  • Provide My Locker features, including card recognition and estimated market values;
  • Produce aggregated or de-identified analytics and pricing insights which we take reasonable steps to ensure cannot reasonably be used to re-identify you;
  • Provide customer support and resolve disputes, returns, and refunds;
  • Send you service communications, and marketing communications where you have opted in;
  • Comply with our legal obligations.

Marketing opt-out: You can withdraw your consent to receiving marketing material at any time using the unsubscribe link in the message you receive or by contacting us using the details below.

Automated processes: We use automated systems to assist with identity verification and to detect fraud and marketplace abuse. These systems may substantially assist decisions that affect you, such as delaying a payout or restricting an account. The kinds of personal information used in these systems include the account, identity verification, marketplace activity, and payment information described in section 1. In each case, our automated systems substantially assist a human decision-maker who makes the final decision. You can contact us to have such a decision reviewed by a person.

4. Disclosure of Information

We may disclose your personal information to:

  • Other users, to complete transactions: when you buy from a seller, that seller (which may be a business or an individual seller) receives your name and, where applicable, delivery details for that order. Sellers may only use this information to fulfil the order. When you sell, buyers see your seller name and in your published returns policy, your contact details (you can mask some of these details in the Service).
  • Resolve enquiries and disputes: if a buyer or seller contacts us in relation to a complaint, enquiry or dispute concerning an order, we may disclose details relating to the fulfilment of the order or the nature of a complaint or dispute to the other party to the transaction.
  • Service providers: hosting providers, email platforms, analytics providers (including Google Analytics), our third-party payment processor, our third-party identity verification provider, and shipping and fulfilment partners.
  • Regulators and law enforcement: where required or authorised by law, or to report suspected fraudulent or illegal activity.
  • Business transfers: if we sell or restructure our business, on terms that protect your personal information.
  • The public, on the website: If you submit reviews and ratings, we may publish them on our website.

We do not sell or rent your personal information to third parties.

5. Use of Cookies

We use cookies to recognise your browser and remember your preferences, and analyse traffic and usage patterns. You can manage or disable cookies through your browser settings, though parts of the Services may not function properly without them.

6. Data Security

We store personal information across our own secure systems and the systems of the third-party service providers described in this Policy (including cloud hosting and payment providers). We take reasonable steps, including technical and organisational measures, to protect the personal information we hold from misuse, interference, loss, and unauthorised access, modification, or disclosure. Identity documents are used for verification and are not retained by Game Locker once verification is complete; they may be retained by our verification provider in accordance with its own privacy policy. No method of transmission over the internet is completely secure, and we cannot guarantee absolute security.

7. Data Retention

We keep personal information only as long as needed for the purposes described in this Policy or as required by law.

Specifically:

  • account information (including your name, email address, phone number and shipping and delivery address details) is kept while your account is active and for 7 years after closure;
  • transaction and remittance records are kept for 7 years to meet tax and accounting obligations;
  • identity verification records are kept for the period required by our verification provider and applicable law; and
  • My Locker data is deleted when your account is closed.

8. Access, Correction, and Deletion

You may request access to the personal information we hold about you, ask us to correct it if it is inaccurate, out of date, or incomplete, or request deletion of your personal data, subject to legal retention requirements. Contact us using the details below and we will respond within a reasonable period. It is free to make a request, but we may charge a reasonable administrative fee to cover the cost of providing you with the requested information.

In some circumstances we may refuse to provide you with personal information that we hold, for example, where providing it would be unlawful. We might sometimes also be legally prevented from telling you why we refuse to provide information.

9. Complaints

If you believe we have mishandled your personal information, contact us using the details below and we will investigate and respond. If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (oaic.gov.au).

10. Overseas Disclosure

Some of our service providers may store or process your information overseas, including in the United States, and Canada. We take reasonable steps to ensure overseas recipients handle your personal information in accordance with the APPs.

11. Data Breaches

We assess suspected data breaches and, where a breach is likely to result in serious harm, notify affected individuals and the Office of the Australian Information Commissioner in accordance with the Notifiable Data Breaches scheme.

12. Changes to This Privacy Policy

We may update this Policy from time to time. Updates will be posted on this page with a revised date, and your continued use of the Services indicates your agreement to the revised Policy.
