Game Locker App Terms

These App Terms apply in addition to the Game Locker Marketplace Terms (Marketplace Terms) if you access the Marketplace or My Locker through Game Locker’s mobile app (whether Apple or Android) (Mobile App). If there’s any inconsistency between the other Game Locker Marketplace Terms and these App Terms, these App Terms will take priority in relation to your use of the app.

1. Licence to use the app

1.1 Mobile App licence. We grant you a personal, non-transferable licence to use the Mobile App on a device you own or control, in accordance with the relevant app store's usage rules, to enable you to access the Marketplace on your mobile device in accordance with the Marketplace Terms.

1.2 Marketplace access. The Marketplace Terms apply to your use of the Marketplace via the Mobile App.

2. Apple’s app store

If you downloaded the Mobile App through Apple's app store, the following terms apply because Apple requires it:

  • (a) These App Terms are between you and Game Locker, not Apple; we (Game Locker), not Apple, are solely responsible for the Mobile App and for any maintenance or support of it.
  • (b) If the Mobile App fails to conform to a warranty, you may notify Apple for a refund of the purchase price; otherwise, Game Locker is solely responsible for any warranty, product liability, legal or regulatory non-conformance, consumer law, privacy or intellectual property claim relating to the Mobile App.
  • (c) You must comply with any third-party terms that apply to your use of the Mobile App (for example, your mobile carrier’s agreement).
  • (d) You must confirm you’re not located in a country subject to United States government embargo or trade sanctions, and aren’t listed on any United States government list of prohibited or restricted parties.
  • (e) Apple (and its subsidiaries) is a third-party beneficiary of these App Terms and may enforce them against you.
  • (f) Direct any questions or complaints you may have about the Mobile App to us at Game Locker using the contact details on Contact Us, not Apple.

3. In-app purchases

3.1 My Locker subscriptions. If you buy a My Locker Pro subscription through the Mobile App, payment will be processed by Apple or Google (not us), under their terms. This will also mean that any refund arrangements will follow their policies rather than ours (see apple.com/legal or play.google.com/about/play-terms). This doesn’t limit your legal rights.

3.2 Marketplace purchases. Marketplace purchases of trading cards are processed through the Game Locker checkout under the Conditions of Sale and in accordance with the Game Locker Marketplace Terms, even if you placed the order using the Mobile App.
